TextbookHub, Inc. (“TextbookHub”) respects your privacy. This Privacy Policy describes what types of information we collect about TextbookHub Users when they access or use the Services, and how TextbookHub uses, stores, and discloses collected information. By using the Services, you consent to our use of your personal information in accordance with this Privacy Policy. This Privacy Policy should be read together with our Terms of Service, and all capitalized terms that are not defined in this Privacy Policy should have the meaning given them in the Terms of Service.
- Personal Information
For the purposes of this Privacy Policy, “personal information” refers to information that identifies or can be used to identify an individual, including but not limited to first and last name, home address, email address, student ID, and financial information.Personal information does not include business contact information of Publisher representatives or School officials and teachers like business phone numbers and business email addresses.“School Student Personal Information” refers to personal information of School Students collected directly from School Students, or received from Schools that have agreements with us. We will not sell School Student Personal Information, or use it for other commercial purposes.Personal information does not include de-identified information about the use of the Services that has all direct and indirect personal identifiers removed and cannot be linked to an identifiable individual, and this Privacy Policy does not restrict our collection and use of such information. We may use de-identified information about Users for any purpose, and share it with third parties without limitations. - What Types of Information We Collect
a. Information Provided by You or Your School
We collect your personal information when you or your School provides it to us. When you create a TextbookHub account, you share certain personal information with us like you name and email address. We may collect additional information about you from your School or from your interaction with the Services, such as information about your school affiliation and school grade, your class schedule, reading statistics, and how you engage with our Services.If you create a TextbookHub account by logging in with your credentials from a third party account using single sign-on like an applicable School information system, School learning management system, or your Google account, you agree togive us access to personal information shared with us through your third party account in accordance with the terms of service and privacy policy of that third party service provider. This information may include your name, username, email address, Student ID, class schedule, information about your school and school grade, and other information on the particular account you connect.
We may also collect your personal information when it is submitted to us voluntarily, for example, when you send us emails or otherwise communicate with us through the Website or app stores.
We do not store any payment information. If you make a purchase on the Website, our payment service provider may collect your name, email address, billing and shipping address, credit card number and expiration date, security code, PayPal account details, and other payment account billing information, as applicable, in order to process your order. Our payment service providers’ privacy policies govern their privacy practices, and we are not responsible for the privacy practices of our payment service providers in relation to purchases made on our Website.
b. User Content
As part of your User Content, you might voluntarily provide us with your personal information. User Content might be made available to your School teachers and other Users. We encourage you to exercise caution and not post any personal information as part of User Content as we can’t protect it once it becomes available for other Users to see. If you share User Content with your School teachers and other Users through TextbookHub, your name is displayed together with your User Content, and User Content can be collected, used, or further shared by other Users. We are not responsible for how other Users use User Content you shared with them through TextbookHub. We reserve the right, but have no obligation to monitor User Content you Share on TextbookHub.c. Information We Collect Automatically
We may collect certain information from your computer or other device as you engage with the Services, such as IP addresses, device and browser type, origin of the user request, access times, and other similar information. We also collect information about the pages you view on the Services, and how you interact with the Services, including your purchase history, and reading statistics (duration and User’s reading path on specific Publications). -
Cookies
TextbookHub and our service providers may use a variety of commonly used technologies such as cookies, pixel tags, web beacons, and/or other similar technologies (collectively “Cookies”) to track information about the use of the Services. Cookies are small data files sent to your computer that store information related to your browser to enable us to recognize your browser when you visit our Services. You can use browser controls to block or delete cookies, however if you choose to reject all cookies, some of the functions of the Services may become unavailable to you.Cookies help us identify you across multiple usage sessions, keep you logged in and remember your preferences, personalize your experience on the Services, monitor you as you navigate the Services, manage the Website, and understand overall usage trends. -
How We Use Your Personal Information
We use your personal information to provide you and your School officials and teachers, as applicable, with the Services and related activities like customer service and training, to perform other activities requested by your School, to communicate with you in connection with providing the Services and replying to your inquiries, to maintain your account in the Services and identify you as a User, to comply with the requirements of the Publishers or our legal obligations, to maintain security, to improve the Services, and to otherwise support the internal operations of the Services.We use your non-personally identifiable information to help us develop, operate, and improve our Services and content, for loss prevention and anti-fraud purposes, for internal reporting, marketing purposes, to conduct research, monitor aggregate usage by Users and perform aggregate analysis, and share data with Publishers, Schools and other partners of TextbookHub. -
How We Share Your Personal Information
We will share your personal information with third parties only in the following scenarios:a. You, your School or parent, as applicable, have explicitly given us consent to share your personal information with third parties;
b. Your personal information is provided to our subsidiaries or affiliated companies provided they are subject to the same privacy commitments as outlined in this Privacy Policy;
c. Your personal information is provided to our, or at the School’s request –to the applicable School’s, trusted vendors or service providers in order to perform the Services;
d. Your personal information is provided to your School officials and teachers, or to the Publishers, as applicable;
e. School Student Personal Information is provided to a Student’s parent/legal guardian as authorized by the School or as required by applicable law;
f. When it is reasonably necessary to disclose specific information as required by law, or if we believe in good-faith that such action is necessary to comply with the law, respond to a court order, subpoena, or warrant;
g. When we in good faith believe that disclosing your personal information to third parties is appropriate or necessary to investigate, prevent, or take action (in our sole discretion) regarding potentially illegal activities, fraud, security or technical issues; or to prevent harm to the rights, property, or safety of the Users or the public as required or permitted by law; or to investigate and defend TextbookHub against third-party claims or allegations;
h. When we determine that disclosure is appropriate or necessary to enforce our rights, including those under our Terms of Service or Privacy Policy;
i. When we sell or transfer your personal information to a successor entity in connection with a merger, acquisition, reorganization, sale of assets, bankruptcy, or other corporate change. The successor entity will be subject to the same privacy commitments as outlined in this Privacy Policy. -
Do Not Track Signals
We do not currently respond to "do not track" signals on web browsers that provide a method to opt out of the collection of information about user activities on the Services and other websites. -
Security
We store and process personal information in accordance with industry best practices. This includes appropriate administrative, physical, and technical safeguards to secure personal information from unauthorized access, disclosure, and use.Although we try hard to maintain the security of personal information, no data transmission or storage system on the Internet can be absolutely secure. We do not warrant or guarantee the security of any information you transmit to us or that your information on the Services may not be accessed, disclosed, altered, or destroyed by a breach. -
Storage, Review, and Deletion of Personal Data
We may retain your personal information for as long as it is necessary to provide you with the Services, comply with our legal obligations, resolve disputes, prevent fraud, enforce our agreements, for tax, audit and liability purposes, or as long as we have a legitimate business need. You may change personal information you have provided to us by going to your account settings.You or your School (for School Students only), may also request to review or delete your personal information collected by us by contacting us at: policy@textbookhub.com. We will delete or de-identify your personal information unless we have a legitimate reason to retain some of it in accordance with applicable law, for example, to comply with our legal obligations or law enforcement requests, resolve disputes, or enforce the Terms of Service.Schools have authority over School Student Personal Information, thus if you are a School Student, or a parent or legal guardian of a School Student under 18 years old, all your requests pertaining to your personal information should be directed to your School. We will follow the School’s directions in regards to School Student Personal Information. -
Children
Our Services are not directed to children under the age of thirteen (13). We do not knowingly collect personal information from children under the age of thirteen (13) or knowingly allow them to register an account with the Services unless they are School Students and their account is registered through their School, where said School has agreed to disclose School Student Personal Information to us for educational purposes. If we become aware that we have collected personal information from a child under age thirteen (13) without their School’s authorization, we will take appropriate steps to remove that information. Please contact us if you believe that we might have collected any information from or about a child under the age of thirteen (13) without authorization. In cases when we have an agreement with a School and they wish to use our Services for their School Students younger than thirteen (13) years old, the School or such School Students may provide us with School Students Personal Information like their name, email address, school affiliation and school grade, class schedule, reading statistics, and how School Students engage with our Services for the purpose of creating their account and providing them with the Services for educational purposes. We rely on the School to provide consent for collection of personal information from their School Students under thirteen (13) years old. The parent or legal guardian of a child under the age of thirteen (13) can review their child's personal information, ask to have it deleted, and prevent any further collection or use of the child's information by contacting the School.We shall not retain School Student Personal Information of children under thirteen (13) years old for any longer than necessary to fulfill the purpose for which it was collected or use such information for commercial purposes. -
Third-Party Websites
The Services may include links to third-party websites, which are outside of our control and have their own privacy policies. We are not responsible for the information handling practices of third-party websites. -
Your California Privacy Rights
In accordance with California’s “Shine the Light” law, Civil Code 1798.83, Users who are California residents may once during a calendar year request certain information about the disclosure of personal information to third parties for the third parties’ direct marketing purposes. We use third-party web analytics services on our Website, such as Google Analytics, to help us analyze how Users use our Website. We may make changes to this Privacy Policy from time to time. Any changes or updates will be effective ten (10) days after the posting of the updated Privacy Policy on our Website. If we make material changes to the Privacy Policy, we will notify you by posting a notice on the Website or via email that you have provided. Your continued use of the Services after the posting of any changes to this Privacy Policy or notification by email constitutes your acceptance of the changes. If you do not agree with the changes, you should stop using the Services. -
